Non-Fault Car Accident: What to Do and the Replacement Vehicle You Can Claim

A non-fault car accident is a collision someone else caused, and if it wasn't your fault you can have your car repaired and a like-for-like replacement vehicle provided with the costs recovered from the at-fault driver's insurer rather than from you; National Accident Support Line arranges the replacement and the repair and pursues the cost, so you do not claim on your own policy or pay an excess.

Most drivers don't know this. They ring their own insurer, pay an excess they never needed to, take whatever courtesy car is available and watch their no-claims discount take the hit at renewal. If the accident wasn't your fault, none of that has to happen. The steps below cover what to do at the scene, what you are entitled to afterwards, and how the claim works when NASL handles it.

What to do after a non-fault car accident

The steps you take at the scene protect you and keep any claim straightforward. Stop and make the scene safe: stopping after a collision is a legal requirement, so switch off the engine and put the hazard lights on. Check for injuries to yourself and your passengers, and call 999 if anyone is hurt or the road is blocked. Exchange details: the other driver's name, address and phone number, their registration and their insurer, and give yours if asked. Gather evidence: photograph the damage to every vehicle, the plates and the wider scene including road markings and signs, save any dashcam footage and take the names of witnesses. Report it to the police if you need to, on 101 if the other driver leaves without giving details, or 999 in an emergency; you must report within 24 hours if anyone was injured or details weren't exchanged. Tell your own insurer the accident happened, even if you don't intend to claim through them, because not reporting it can breach your policy.

One thing worth knowing at the scene: don't apologise or accept blame, even to be polite. Fault is decided on the evidence, and a clear non-fault claim is settled faster.

What a non-fault accident entitles you to

Because the accident wasn't your fault, you don't have to claim through your own insurer and pay your excess. You can claim a replacement vehicle and your repairs through credit hire, where the costs are recovered from the at-fault driver's insurance company rather than from you. In practice that means a like-for-like replacement while yours is off the road, your car repaired, and the bill sent to the driver who caused the accident. If your car is beyond economical repair, its pre-accident value is pursued from the at-fault insurer, and you still get a replacement while that is settled.

Like-for-like means a vehicle equivalent to yours: same size, same class, same number of seats, an automatic if you drive an automatic. If you drive a 7-seater, you get a 7-seater. That is the part most people searching after a non-fault accident don't know they are entitled to, and it is the difference between credit hire and a courtesy car.

What National Accident Support Line does on a non-fault claim

We confirm the accident wasn't your fault before anything else moves, because a verified claim is one the at-fault insurer pays without argument. Then we arrange the replacement, like-for-like where availability allows, from a fleet of over 4,000 vehicles across 300-plus models including hybrid and electric, and we aim to have you in it within 48 hours on claims where your car isn't roadworthy. We arrange the repair, or pursue the pre-accident value if the car is written off, and we recover the costs from the at-fault driver's insurer.

If the other driver's insurer disputes who was at fault, our in-house recovery team takes the case on and argues it with them directly, on the evidence. We take on complex and disputed-liability claims that many companies won't, and we work each claim until every option has been pursued. You don't chase anyone yourself. And if you were injured in the accident, we can help with that too, through a car accident injury claim handled alongside the vehicle claim.

The situations drivers describe to us

"Someone reversed into me while I was parked"

The clearest non-fault case there is, and still the one where drivers most often end up claiming on their own policy out of habit. There is no question of liability, so there is no reason for you to pay an excess or use your no-claims discount.

"They apologised at the scene, now their insurer says it was my fault"

It happens more than you'd think. Someone says sorry on the day, then their insurer hears a different version. Fault isn't decided by who says what. It is decided on the evidence: photos, dashcam, witnesses, the damage itself. Send us everything and our recovery team argues it.

"My insurer says I'm not covered for a courtesy car"

Many policies don't include one, and most stop it the moment a car is declared a write-off. A non-fault claim doesn't depend on your policy. The replacement is a cost of the accident, recovered from the driver who caused it.

"I drive a taxi, a standard car is no use to me"

You need a plated replacement, licensed for your area, which we arrange separately. See PCO and taxi credit hire for how that works.

A recent example

Ishfan, a driver in Oldham, had an accident that wasn't his fault. We had a like-for-like replacement with him within 48 hours and handled his repair, and his car was off the road for 24 days. He paid nothing, with the costs recovered from the at-fault driver's insurer. (Details anonymised at the customer's request.)

Frequently asked questions

Am I entitled to a replacement car if the accident wasn't my fault?

Yes. If the accident wasn't your fault, you can have a like-for-like replacement vehicle while your own car is repaired or replaced, with the charges recovered from the at-fault driver's insurer rather than from you.

Do I have to pay my excess if the accident wasn't my fault?

Not when the claim is made against the at-fault driver's insurer rather than under your own policy. No excess to pay if the accident wasn't your fault, and no deposit on the replacement vehicle.

Will a non-fault accident affect my insurance or no-claims discount?

On a straightforward non-fault claim handled against the other driver's insurer, your no-claims discount is not used. Insurers do ask about accidents at renewal, including non-fault ones, so tell your insurer it happened even though you are not claiming through them.

What happens if my car is written off and it wasn't my fault?

We pursue the pre-accident value of your car from the at-fault driver's insurer, along with the other costs the accident caused, and you keep a replacement vehicle while the value is settled.

Do I have to report a non-fault accident to my own insurer?

Yes. Most policies require you to report any accident, whether or not you claim, and not doing so can breach the policy. Reporting it is not the same as claiming on it.

Do I have to use my own insurer?

No. A non-fault driver can claim directly against the at-fault driver's insurer, and an accident management company like NASL handles that claim for you, including the replacement vehicle and the repair.

How long does a non-fault claim take?

The replacement vehicle is the fast part, within 48 hours on non-drivable claims where liability is clear. Settling the claim depends on the repair and on whether the at-fault insurer accepts liability quickly; disputed cases take longer, and you keep the replacement while they are argued.
